Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Legal Aid Commission Act 1979.

1Name of Regulation

This Regulation is the Legal Aid Commission Regulation 2011.

2Commencement

This Regulation commences on the 1 September 2011 and is required to be published on the NSW legislation website.

Note—

This Regulation replaces the Legal Aid Commission Regulation 2006 which is repealed on 1 September 2011 by section 10 (2) of the Subordinate Legislation Act 1989.

3Definition(1)

In this Regulation:

the Act means the Legal Aid Commission Act 1979.

Notes included in this Regulation do not form part of this Regulation.

4Term of appointment to a panel(1)

For the purposes of section 52 (1) of the Act, the term of appointment of a legal practitioner to a panel is:

  • (a)

    5 years, except as provided by paragraph (b), or

  • (b)

    such period (not exceeding 5 years and not less than 2 years) as may be specified in the instrument of appointment.

(2)

This clause does not extend to the term of appointment of a legal practitioner appointed to a panel before the commencement of this clause.
