LEE

v

KINGSFIELD HOLDINGS PTY LTD & ORS

[2024] HCASL 79
P27/2023

  1. The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of Western Australia (Vaughan and Hall JJA) dismissing as incompetent an appeal from a decision of the Supreme Court of Western Australia (Lundberg J), which in turn dismissed the applicant's application for leave to proceed pursuant to s 60(4)(a) of the Bankruptcy Act 1966 (Cth).

  2. The proposed grounds of appeal in the applicant's amended application for special leave to appeal raise no question of principle which is suitable for the grant of special leave to appeal. An appeal to this Court would enjoy no prospects of success.

  3. Special leave to appeal is refused.
