LEE & ORS

v

DEPUTY COMMISSIONER OF TAXATION & ANOR

[2023] HCASL 114
S24/2023

  1. The applicants seek special leave to appeal from a judgment of the Full Court of the Federal Court of Australia (Thawley, Stewart and Abraham JJ) dismissing an appeal by the applicant against the Federal Court of Australia's (Bromwich J) order refusing the applicants' interlocutory application for suppression and related orders.

  2. The Full Court applied well-established principles with respect to the assessment of applications for suppression and access orders. Their Honours' interpretation of Div 355 of Sch 1 to the Taxation Administration Act 1953 (Cth) concerning "protected information" was also plainly correct.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
