Application for variation of The Heritage Lion Dairy & Drinks Maintenance Agreement 2013.

[1] An application has been made for approval of a variation to The Heritage Lion Dairy & Drinks Maintenance Agreement 2013 1(the Agreement). The application was made by LD & D Foods Pty Ltd T/A Lactos pursuant to section 210 of the Fair Work Act 2009 (the Act).

[2] The application seeks approval of various variations, including variations to the Agreement to implement a new roster. Clauses varied include Clause 6 “Individual Flexibility” , Clause 12 “Hours of Work, Rostering and Overtime”, Clause 13 “Personal Carer’s Leave”, Clause 14 “Annual Leave”, Clause 20 “Public Holidays” and Clause 28 “Dispute Settlement Procedure”.

[3] I am satisfied that each of the requirements of ss.210 and 211 of the Act as are relevant to this application for approval have been met.

[4] The variation is approved and the consolidated version of the Agreement, as varied, is attached to this decision.

[5] In accordance with s.216 of the Act, the variation operates from 21 October 2014.
