Laying Chicken Levy Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and having taken into consideration recommendations made to the Minister for Primary Industries and Energy by the Australian Egg Industry Association Incorporated, make the following Regulations under the Laying Chicken Levy Act 1988.

1.   Commencement

1.1   These Regulations (except regulation 4) commence on 1 July 1997.

1.2   Regulation 4 commences on 1 July 1998.

2.   Amendment

2.1   The Laying Chicken Levy Regulations are amended as set out in these Regulations.

3.   Regulation 3 (Prescribed amounts)

3.1   Omit the regulation, substitute:

Prescribed rates of levy

 “3. (1) For paragraph 7 (a) of the Act, 7.2 cents is prescribed.

[Note: The levy mentioned in subregulation (1) is attached to the Rural Industries Research and Development Corporation—see section 6 of the Primary Industries and Energy Research and Development Act 1989 and regulation 9E of the Rural Industries Research and Development Corporation Regulations.]

 “(2) For paragraph 7 (b) of the Act, 0.33 cents is prescribed.

[Note: The levy mentioned in subregulation (2) is to fund the Australian Animal Health Council.]”.

4.   Regulation 3 (Prescribed rates of levy)

4.1   Subregulation 3 (2):

Omit the subregulation.

[Note: After the commencement of regulation 4, the Note that followed the omitted subregulation should be omitted and the following Note substituted:

“Note: Paragraph 7 (b) of the Act sets a levy rate of 0.21 cents per laying chicken to fund the Australian Animal Health Council, if no other rate is prescribed by the Regulations for that paragraph.]”.]
