MR J. BASTEN, QC:   Your Honour, I appear with my learned friend, MR G.J.L. SCRAGG, for the applicant.  (instructed by Jacovou Barlow & Associates.

MR R.D. ELLIS:   Your Honour, I appear for the respondent.  (instructed by S.E. O’Connor, Solicitor for Public Prosecutions)

MR BASTEN:   I think this may be briefly dealt with, accepting what your Honour suggested this morning that it would be appropriate if it were stood until judgment were given in Adam, possibly with the possibility of leave for supplementary submissions, if that were appropriate after the judgment.

GLEESON CJ:   Yes, certainly, Mr Basten.  Do you agree to that, Mr Ellis?

MR ELLIS:   Certainly, your Honour, yes.

GLEESON CJ:   I think that is a good idea, having regard to the issues that were argued in that.  Very well, by consent this matter will be stood over today’s list, to be fixed again after the Court has given its reasons for judgment in the matter of Adam v The Queen, and both parties will have leave to supplement their written submissions in the light of that decision, as they may be advised.
