Law Enforcement Conduct Commission Amendment Act 2020 (NSW)

An Act to amend the Law Enforcement Conduct Commission Act 2016 in relation to the eligibility requirements for appointment of the Chief Commissioner and in relation to vacancy of offices and to amend the Government Sector Employment Act 2013 with respect to statutory officers of the Law Enforcement Conduct Commission.

1Name of Act

This Act is the Law Enforcement Conduct Commission Amendment Act 2020.

2Commencement

This Act commences on the date of assent to this Act.

Schedule 1Amendment of Law Enforcement Conduct Commission Act 2016 No 61[1]Section 18 The Commissioners

Omit section 18(3).

Omit “Commissioner for Integrity or Commissioner for Oversight or to act in either office”.

Insert instead “a Commissioner or to act in the office of a Commissioner”.

The removal from office of a member of the Commission, or an Assistant Commissioner, or an alternate Commissioner, under Part 6 of the Government Sector Employment Act 2013 before the commencement of the Law Enforcement Conduct Commission Amendment Act 2020 is taken to have created a vacancy in that office.
