CaseChat Overview and Summary

The case of Laval Pty Ltd v Hackham Plaza Investments Pty Ltd was an appeal against the decision of the Licensing Court granting a retail liquor merchant's licence to Hackham Plaza Investments Pty Ltd for premises at Hackham. The appeal was heard by the Full Court of the Supreme Court of South Australia, comprising Prior, Debelle, and Bleby JJ. The central issue was whether Hackham Plaza satisfied the requirements of s 58(2) of the Liquor Licensing Act 1997, which mandates that an applicant must demonstrate that existing licensed premises in the locality do not adequately cater for the public demand for liquor and that the licence is necessary to meet that demand.

The Licensing Court had previously dismissed two applications by Hackham Plaza for the same premises in 1999 and 2001. However, in a third application in 2003, the Licensing Court granted the licence, a decision which the objectors appealed. The Full Court examined whether there had been material changes in circumstances since the previous applications that warranted a different conclusion. The Court found that there were no material changes in the population, the location of existing licensed premises, or the demand for liquor that justified granting the licence. Notably, the Aussie Inn had improved its facilities, becoming a more convenient option for liquor purchases, which militated against the need for an additional outlet. The Court concluded that the judge's decision was erroneous, and the appeal was allowed, setting aside the Licensing Court's judgment and dismissing the application for the licence.
