492 Lang Park Trust Act Amendment Act 1981, No. 58 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows: - 1. Short title and citation . (1) This Act may be cited as the Lang Park Trust Act Amendment Act 1981. (2) In this Act The Lang Park Trust Act of 1962 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Lang Park Trust Act 1962-1981. 2. Amendment of s. 11. Section 11 of the Principal Act is amended by- (1) (a) in subsection (2), omitting the words " three hundred and forty-eight " and substituting the words " three hundred and forty-seven "; (ii) omitting the proviso and substituting the following proviso:- Provided that- (a) the said section three hundred and forty-three shall so apply in a case where the purpose of the proposed lease or agreement to lease is other than recreation and sporting purposes and the approval of the Governor in Council is first obtained authorising the lease or agreement for that purpose as if paragraph (b) of subsection (4) did not appear therein; and (b) section three hundred and forty-four of the said Act shall so apply as if the words " for renewal of lease or " did not appear therein."; (b) adding at the end of the section the following subsection:- (5) It is not competent to the Governor in Council to approve under subsection (2) of a lease or agreement to lease for the purpose of using the land, the subject thereof, or any part of that land for erecting any building or structure to be used as a department store or supermarket or as premises, consisting of or including two or more shops or stalls, devoted solely or principally to the sale, by retail or wholesale, of goods manufactured or produced elsewhere than on those premises. If the Governor in Council approves of a lease or agreement that, under this subsection, is not within his competence to approve such approval shall be ineffective.".
