2 Lands Legislation Amendment (No. 1) No. 84, 1993 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Lands Legislation Amendment Regulation (No. 1) 1993 . PART 2—AMENDMENT OF LAND REGULATION 1988 ˙ Amended regulation 2. The Land Regulation 1988 is amended as set out in this Part. ˙ Amendment of s.5 (Interpretation) 3. Section 5 (definitions “Act”, “Chairperson”, “member” and “Secretary” )— omit . ˙ Omission of Part 2 (LAND ADMINISTRATION COMMISSION) 4. Part 2— omit . ˙ Insertion of new s.51 (Prescribed guidelines) 5. After section 50— insert— ˙ ‘Prescribed guidelines ‘51.(1) Guidelines prescribed for the purposes of sections 188(14), 194(17), 204D(3) and 212(18) of the Act are set out in subsections (3) to (6).
3 Lands Legislation Amendment (No. 1) No. 84, 1993 ‘(2) The guidelines set out in subsections (3) to (5) are not intended to be conclusive as to the existence of hardship. ‘(3) Hardship may be substantiated if the lessee holds, or is entitled to hold, a Commonwealth concession card (Example—Pensioner Health Benefits Card, Health Care Card and Health Benefit Card). ‘(4) Hardship may be substantiated if the net value of the lease constitutes a significant proportion of the net value of all property owned by the lessee. ‘(5) Hardship may be substantiated if the annual instalment or rent required to be paid under the lease is a significant proportion of the lessee’s annual income. ‘(6) In addition to considering the guidelines mentioned in subsections (3) to (5), the Minister is to consider any other circumstances brought to the Minister’s attention that may suggest that the lessee is experiencing hardship. ’. PART 3—AMENDMENT OF PROPERTY LAW REGULATION 1975 ˙ Amended regulation 6. The Property Law Regulation 1975 is amended as set out in this Part. ˙ Amendment of Schedule 7. Schedule (item no. 1)— omit office of the Registrar ’, insert land registry ’.
