AN ORDINANCE

To amend the Landlord and Tenant Ordinance 1949-1972.

x THE GOVERNOR-GENERAL in and over the Commonwealth of
I , Australia, acting with the advice of the Federal Executive Council,
hereby make the following Ordinance under the Seat of Government
(Administration) Act 1910-1972.

LANDLORD AND TENANT ORDINANCE 1973

1. (1) This Ordinance may be cited as the Landlord and Tenant

Ordinance 1973.*

(2 ) The Landlord and Tenant Ordinance 1949-1972f is in this

Ordinance referred to as the Principal Ordinance.

(3) The Principal Ordinance, as amended by this Ordinance, may

be cited as the Landlord and Tenant Ordinance 1949-1973.

2. Section 8 of the Principal Ordinance is amended by inserting in sub-section ( 1 ) , after the definition of " the Controller ", the following definition:—

t Ordinance N o . 6, 1949, as amended by N o . 10, 1952; N o . 3, 1937; N o . 19, 1966; and N o . 36, 1972.

" ' the Cour t ' means the Court of Petty Sessions; ".

3. Section 70 of the Principal Ordinance is repealed and the follow­

ing section substituted:—

" 70. The Court of Petty Sessions has jurisdiction in proceedings

under Part III.".

4. Section 75 of the Principal Ordinance is repealed and the follow­

ing section substituted:—

" 7 5 . (1 ) An appeal lies to the Supreme Court from a judgment or

order of the Court in proceedings under this Part.

" (2) The provisions of Division 2 of Part XI of the Court of Petty Sessions Ordinance 1930-1972 apply to and in relation to an appeal under sub-section (1) as if it were an appeal from an order of the Court of the kind referred to in paragraph (h) of sub-section (1) of section 208 of that Ordinance.".

5. Section 78 of the Principal Ordinance is amended—

(a)

by omitting from sub-section (1) the words "the appropriate court" and substituting the words " the Court" ; and

(b) by omitting sub-sections (4) and (5).

6. The Principal Ordinance is amended as set out in the Schedule.
