Land Valuers Regulations 2024

under the Land Valuers Act 1994

1Short title

These regulations may be cited as the Land Valuers Regulations 2024.

2Commencement

These regulations come into operation on 1 September 2024.

3Interpretation
  1. (1)

    In these regulations—

Act means the Land Valuers Act 1994.

  1. (2)

    For the purposes of these regulations, a reference to a qualification or subject conferred or offered by a particular institution includes a reference to a qualification or subject of a different name conferred or offered by that institution and certified by that institution to be an equivalent qualification or subject.

4Qualifications required to be held by land valuers

For the purposes of sections 5(a) and 6(a) of the Act, an individual must hold at least 1 of the following qualifications:

  1. (a)

    degree of Bachelor of Business (Property) conferred by the University of South Australia or Adelaide University, including satisfactory completion of (or status granted in) the subject of Statutory Valuations and at least 1 of the following subjects or combinations of subjects:

    1. (i)

      Valuation of Investment Properties;

    2. (ii)

      Advanced Property Valuation;

    3. (iii)

      Property Practice and Commercial Property Valuation;

  2. (b)

    Graduate Diploma in Property, or degree of Master of Business in Property or degree of Master of Business (Property), conferred by the University of South Australia, including satisfactory completion of (or status granted in) the following subjects:

    1. (i)

      1. (A)

        Property Law 1G and 2G; or

      2. (B)

        Property Law 2M; or

      3. (C)

        Law of Property G;

    2. (ii)

      1. (A)

        Property Case Studies, Real Estate Valuation 1, Real Estate Valuation 2, Real Estate Valuation 3 and Valuation Case Studies; or

      2. (B)

        Statutory Valuation G and Valuation of Investment Property G; or

      3. (C)

        Statutory Valuation G and Advanced Property Valuation G;

  3. (c)

    degree of Bachelor of Business in Property conferred by the University of South Australia, including satisfactory completion of (or status granted in) the following subjects:

    1. (i)

      Valuation 1 and 2;

    2. (ii)

      Valuation Field Work 1 and 2;

  4. (d)

    membership of the Australian Property Institute holding the certification of Certified Practising Valuer, Certified Practising Valuer (Residential) or Residential Property Valuer;

  5. (e)

    membership as a full member, senior member, fellow member or life fellow member of the Property Institute of New Zealand;

  6. (f)

    membership of the Royal Institution of Chartered Surveyors as a Chartered Valuation Surveyor or a Fellow Member;

  7. (g)

    in the case of an individual who—

    1. (i)

      immediately before the commencement of these regulations had qualifications declared under the Land Valuers Regulations 2010 to be prescribed qualifications—those qualifications; or

    2. (ii)

      immediately before the commencement of the Land Valuers Regulations 2010 had qualifications declared under the Land Valuers Regulations 1995 to be prescribed qualifications—those qualifications.

Schedule 1—Repeal of Land Valuers Regulations 2010

The Land Valuers Regulations 2010 are repealed.
