Land Valuation Amendment (Relocatable Homes) Act 1999

An Act to amend the Land Valuation Act 1971

[Royal Assent 15 December 1999]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Land Valuation Amendment (Relocatable Homes) Act 1999 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Land Valuation Act 1971 is referred to as the Principal Act. 4Section 12 amended (Duty of Valuer-General to make valuation) Section 12 of the Principal Act is amended as follows: (a) by omitting "State." from the definition of State authority in subsection (1A) and substituting "State;"; (b) by inserting the following definition after the definition of State authority in subsection (1A) : structure includes – (a) any building or erection; and (b) a relocatable structure, building or device that is plumbed or connected to the ground or otherwise made capable of human occupation, other than a mobile home or caravan that is or is capable of being fitted with wheels for the purpose of transportation. (c) by inserting the following paragraph after paragraph (b) in subsection (3) : (ba) the land is taken to include any structure that the Valuer-General determines is occupied or is capable of being occupied; (d) by omitting subsection (4) and substituting the following subsection: (4)  For the purpose of this Act, in the assessment of the capital value of land – (a) in the case of land that is occupied for trade, business or manufacturing purposes, the land is not taken to include any plant, machine, tool or appliance not fixed to the land or fixed to the land in such a manner that it is capable of being removed without structural damage to the land, or the foundations of the plant, machine, tool or appliance; and (b) the land is taken to include any structure that the Valuer-General determines is occupied or is capable of being occupied.
