AN ORDINANCE

To amend the Land Valuation Ordinance 1936

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Adminis­ tration) Act 1910.

LAND VALUATION (AMENDMENT) ORDINANCE 1978

1. This Ordinance may be cited as the Land Valuation (Amend­

ment) Ordinance 1978.*

2. Section 15 of the Land Valuation Ordinance 1936f is repealed and the following section substituted:

" 1 5 . (1) The Commissioner shall be paid such fees and allow­ ances as would be payable to him under the Remuneration Ordinance 1976 if he were the chairman of a prescribed authority within the meaning of that Ordinance.

" (2) For the purpose of sub-section ( 1 ) —

(a)

where the Commissioner is engaged in conducting a hearing under this Ordinance, he shall be taken to be attending a meeting of a prescribed authority;

(b)

where the Commissioner is otherwise engaged in the per­ formance of his duties under this Ordinance, he shall be taken to be engaged, with the approval of a prescribed authority, on business of the authority; and

(c)

where the Commissioner is necessarily absent overnight from his place of residence in order to perform his duties, he shall be taken to be necessarily absent overnight from his place of residence in order to perform business of a prescribed authority on which he is engaged with the approval of the authority.".
