I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Land Use Planning and Approvals Act 1993 .20 December 2001

1Short titleThese regulations may be cited as the Land Use Planning and Approvals (Application of Act) Amendment Regulations (No. 2) 2001 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Land Use Planning and Approvals (Application of Act) Regulations 1994 are referred to as the Principal Regulations. 4Regulation 5 insertedAfter regulation 4 of the Principal Regulations , the following regulation is inserted: 5Excluded development: supply pipelines For the purpose of the definition of "development" in the Act, the construction of a supply pipeline as defined in the Gas Pipelines Act 2000 is not included within that definition if – (a) that construction is in conjunction with the construction of a transmission pipeline as defined in the Gas Pipelines Act 2000 that is constructed in accordance with a permit; and (b) no part of that construction is more than 10 metres from that transmission pipeline.
