s1 2 s5 Land Title Transitional Amendment (No. 1) No. 356, 1994 ˙ Short title 1. This regulation may be cited as the Land Title Transitional Amendment Regulation (No. 1) 1994 . ˙ Commencement 2. This regulation commences on 24 April 1994. ˙ Regulation amended 3. This regulation amends the Land Title Transitional Regulation 1994 . ˙ Insertion of new s 2A 4. After section 2— insert— ˙ Definition 2A . In this regulation— “proposed lot” means that which will become a lot, including a lot within the meaning of the BuildingUnitsandGroupTitlesAct1980 and Schedule 7 of the South Bank Corporation Act 1989 , on— (a) the registration of a plan of survey; or (b) the registration of a building units plan, a group titles plan or a leasehold building units plan; or (c) the recording of particulars of a deed of grant.’. ˙ Insertion of new s 4 5. After section 3— insert— ˙ Instruments of title 4.(1) The purpose of this section is to make provision about the rights of certain persons with an interest in registered freehold land to assist the
s5 3 s5 Land Title Transitional Amendment (No. 1) No. 356, 1994 transition from the operation of the Acts repealed by the Act to the operation of the Act. (2) This section applies to a lot, or proposed lot, for which a certificate of title has not issued or has been cancelled. (3) If— (a) a document— (i) was executed or made before 24 April 1994; or (ii) is executed or made on or after 24 April 1994 and before 1 January 1995; and (b) the document relates to a lot or proposed lot to which this section applies; and (c) the document affects or could affect the rights of persons with an interest in the lot or proposed lot; this section applies to the document. (4) A reference in the document to the issue of a certificate of title is a reference to the recording of the particulars of the lot in the freehold land register. (5) If the document contains a requirement that a person produce the certificate of title for the lot, the document is to be read as if it did not contain the requirement. (6) This section is a law to which section 20A of the Acts InterpretationAct 1954 applies. (7) This section expires on 31 December 1994.’. ENDNOTES 1.
