134 QLtEEZts .laxn ANNO VICESIMO TERTIO ELIZABETHAE SECUNDAE REGI N AE No. 13 of 1974 An Act to amend The Land Surveyors Acts, 1908 to 1916 in a certain particular [ASSENTED TO 18TH APRIL, 1974] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Land Surveyors Act Amendment Act 1974. (2) The Land Surveyors Act of 1908 as subsequently amended is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Land Surveyors Act 1908-1974.
Land Surveyors Act Amendment Act 1974, No. 13 135 2. Amendment of s. 9. Section 9 of the Principal Act is amended by omitting subsection (3) and substituting the following subsection:- " (3) The Board, instead of requiring a person to pass a written examination in all the prescribed subjects, may accept evidence satisfactory to it, that he has passed in all or any of those subjects, a written examination conducted by the Surveyors Board or other competent authority in a co-operating state being a board or authority recognised by the Board, or conducted by a university or other teaching or examining institution in any State or Territory of the Commonwealth, or other country, to a standard that is acceptable to the Board. Acceptance by the Board of evidence of passing a written examination referred to in this subsection shall have the same force and effect as the passing of an examination conducted by the Board.". 3. Validation of acts. Every acceptance by the Board purportedly given under section 9 (3) of the Principal Act that would have been duly given had it been given under that subsection as enacted by this Act shall be deemed to have been duly given and shall have and be deemed to have always had effect as if it had been given under that subsection as enacted by this Act and no registration granted by the Board as a consequence of such an acceptance shall be questioned on the ground that the acceptance was not duly given.
