Land (Revocation of Reservations) Act 2008

The Parliament of Victoria enacts:

1Purposes

The main purposes of this Act are—

(a)to revoke the permanent reservation of certain land at Yarrawonga;

(b)to revoke the permanent reservation and related Crown grant of land occupied by the Talbot Free Library;

(c)to revoke the permanent reservation of certain land at Marlo;

(d)to revoke the permanent reservation of certain land at Boorhaman;

(e)to revoke the permanent reservation of certain land at Brimin;

(f)to revoke the permanent reservation of land occupied by Mount Duneed Primary School.

2Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3Definition

In this Act—

Central Plan Office means the Central Plan Office of the Department of Sustainability and Environment.

4Revocation of reservation—Yarrawonga land

The Order in Council specified in item 1 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 2.

5Revocation of reservation—Talbot Free Library

(1)The Order in Council specified in item 2 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 3.

(2)Crown grant Volume 2560 Folio 511951 is revoked.

6Revocation of reservation—Marlo land

(1)The Order in Council specified in item 3 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan lodged in the Central Plan Office and numbered LEGL/07-035.

(2)Despite subsection (1), the lease of land granted by the Minister for Environment and Climate Change to Ian Cameron McKeown, with a commencement date of 1 September 2007, granted over Crown Allotments 2002, 2003, 2004, 2005, 2006, 2007 and 2008, Parish of Orbost East, insofar as it applies to land to which this section applies, continues in force as if it were a lease granted under the Land Act 1958.

7Revocation of reservation—Boorhaman land

The Order in Council specified in item 4 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 4.

8Revocation of reservation—Brimin land

The Order in Council specified in item 5 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 5.

9Revocation of reservation—Mount Duneed land

The Order in Council specified in item 6 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 6.

10Consequences of revoking reservations

On revocation of an Order in Council reserving land—

(a)that land is deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and

(b)the appointment of any committee of management of that land is revoked to the extent that it relates to that land; and

(c)the appointment of any trustee of the land is revoked to the extent that the appointment relates to that land; and

(d)any regulations under section 13 of the Crown Land (Reserves) Act 1978 are revoked to the extent that they apply to that land.

11Registrar of Titles to make necessary amendments

The Registrar of Titles must make any recordings in or amendments to the Register kept under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of this Act.

SCHEDULE 1

Land in Respect of which Reservations are Revoked

Item 1—Yarrawonga land

Situation and area of land: Township of Yarrawonga, Parish of Yarrawonga, 1223 square metres, being Crown Allotment 2001.
Instrument and date of reservation: Order in Council dated 23 May 1881.
Description of land by reference to Government Gazette: Government Gazettes dated 11 February 1881, page 484 and 27 May 1881, page 1389.
Purpose of reservation: Site for public purposes.
Extent of revocation: The land shown hatched on the plan in Schedule 2.

Item 2—Talbot Free Library

Situation and area of land: Township of Talbot, 708 square metres, being Crown Allotment 5A, Section E, Township of Talbot, Parish of Amherst, County of Talbot.
Instrument and date of reservation: Order in Council dated 22 January 1889.
Description of land by reference to Government Gazette: Government Gazettes dated 14 December 1888, page 3993 and 25 January 1889, page 257.
Particulars of Crown Grant: Crown Grant Volume 2560 Folio 511951.
Purpose of reservation: Site for a free library.
Extent of revocation: The land shown hatched on the plan in Schedule 3.

Item 3—Marlo land

Situation and area of land: Parish of Orbost East, 4929 square metres, being Crown Allotments 2002, 2003, 2004 and 2005.
Instrument and date of reservation: Order in Council dated 23 May 1881.
Description of land by reference to Government Gazette: Government Gazettes dated 4 March 1881, page 691 and 27 May 1881, page 1389.
Purpose of reservation: Site for public purposes.
Extent of revocation: The land shown hatched on the plan in the Central Plan Office and numbered LEGL/07-035.

Item 4—Boorhaman land

Situation and area of land: Parish of Boorhaman, County of Bogong, 105 square metres, being Crown Allotment 1F.
Instrument and date of reservation: Order in Council dated 23 May 1881.
Description of land by reference to Government Gazette: Government Gazettes dated 4 March 1881 page 691 and 27 May 1881, page 1389.
Purpose of reservation: Site for public purposes.
Extent of revocation: The land shown hatched on the plan in Schedule 4.

Item 5—Brimin land

Situation and area of land: Parish of Brimin, County of Bogong, 106 square metres, being Crown Allotment 5E, Section J.
Instrument and date of reservation: Order in Council dated 23 May 1881.
Description of land by reference to Government Gazette: Government Gazettes dated 4 March 1881, page 691 and 27 May 1881, page 1389.
Purpose of reservation: Site for public purposes.
Extent of revocation: The land shown hatched on the plan in Schedule 5.

Item 6—Mount Duneed land

Situation and area of land: Parish of Duneed, County of Grant, 1.214 hectares, being Crown Allotment 2002.
Instrument and date of reservation: Order in Council dated 8 February 1886.
Description of land by reference to Government Gazette: Government Gazettes dated 11 December 1885, page 3478 and 12 February 1886, page 344.
Purpose of reservation: Site for public recreation.
Extent of revocation: The land shown hatched on the plan in Schedule 6.

The Land (Revocation of Reservations) Act 2008 was assented to on 3 June 2008 and came into operation on 4 June 2008: section 2.
