Land (Planning and Environment) Regulations Amendment
Subordinate Law 1999 No 31
The Australian Capital Territory Executive makes the following regulations under the Land (Planning and Environment) Act 1991.

Commencement
These regulations commence on the day they are notified in the Gazette.
Regulations amended
These regulations amend the Land (Planning and Environment) Regulations.
Substitution
Regulation 1 is repealed and the following regulation substituted:
Name of regulations
These regulations are the Land (Planning and Environment) Regulations 1992.”.
Interpretation
Regulation 2 is amended by inserting in paragraph (f) of the definition of exempt building or structure in subregulation (1) “(other than a satellite dish, or microwave antenna, that is for receiving purposes only)” after “aerial”.
Schedule 1
Schedule 1 is amended by adding at the end the following items:
| “32. | Installation or alteration of a satellite dish that is for receiving purposes only on a building in a residential area where, as installed or altered— (a) the face of the dish would be capable of being contained within a circle 0.65 metres in diameter; and (b) no part of the dish or its supporting structure would project above the roof ridge line of any adjacent area of roof that is a pitched roof; and (c) the dish and its supporting structure would be colour-matched to its background and have a matt finish; and (d) the dish and its supporting structure would not be visible from the public street adjacent to the front boundary of the block of land on which the building is situated; and (e) the dish and its supporting structure would— (i) not be visible from a block of leased Territory land adjacent to the block on which the building is situated; or (ii) be not less than 4 metres from the boundary of any block of leased Territory land adjacent to the block on which the building is situated. |
| 33. | Installation or alteration of a satellite dish that is for receiving purposes only on a building that is not in a residential area where, as installed or altered— (a) the face of the dish would be capable of being contained within a circle 1.5 metres in diameter; and (b) the dish and its supporting structure would be colour-matched to its background and have a matt finish; and (c) the dish and its supporting structure would not be conspicuous from an adjacent residential area. |
| 34. | Installation or alteration of a microwave antenna that is for receiving purposes only on a building where, as installed or altered— (a) the face of the dish of the antenna would be capable of being contained within a circle 0.65 metres in diameter; and (b) the antenna and its supporting structure would be— (i) not more than 1 metre high; and (ii) colour-matched to its background and have a matt finish. |
| 35. | Removal of a satellite dish or microwave antenna referred to in items 32, 33 or 34 from a building.”. |
