Land (Planning and Environment) Regulations1 (Amendment)

The Australian Capital Territory Executive makes the following Regulations under the Land (Planning and Environment) Act 1991.

Commencement

1.  These Regulations commence on the day on which they are notified in the Gazette.

Principal Regulations

2.  In these Regulations, “Principal Regulations” means the Land (Planning and Environment) Regulations.

Exemption of controlled activities from provisions of Part VI of the Act

3.  Regulation 21 of the Principal Regulations is amended—

(a)by adding at the end of paragaph (2) (a) “or”;

(b)by omitting paragraph (2) (c);

(c)by inserting after subregulation (2) the following subregulation:

“(2A)  Part VI of the Act does not apply in respect of the variation of a lease, in accordance with the provisions of the lease, to reduce the area of land comprised in the lease.”;

(d)by omitting from subregulation (3) “Sections 229 and 276 of the Act do” and substituting “Part VI of the Act does”; and

(e)by omitting from paragraph (3) (a) “was granted before the commencement of these Regulations and”.
