The Australian Capital Territory Executive makes the following regulations under the Land (Planning and Environment) Act 1991.

Land (Planning and Environment) Act 1991

1. Name of regulations

   These regulations are the Land (Planning and Environment) Amendment Regulations 2004 (No 2).

2. Commencement

   These regulations commence on the day after their notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3. Legislation amended

   These regulations amend the Land (Planning and Environment) Regulations 1992.

4. Regulation 20

   omit

   For the Act,

   substitute

   (1)For the Act,

5. Regulation 20 (f)

   substitute

   (f)provide land for the exclusive use of community organisations; or

   (g)assist occupiers of premises affected, or likely to be affected, by the operation of the Smoking (Prohibition in Enclosed Public Places) Act 2003, part 2 (Smoking prohibited in enclosed public places) to provide additional facilities at the premises.

6. New regulation 20 (2) and (3)

   insert

   (2)Subregulation (1) (g) applies only to an application for variation of a lease made before 1 December 2009.

   (3)Subregulation (1) (g), subregulation (2) and this subregulation expire on 1 December 2010.
