An Act to amend the Land (Planning and Environment) Act 1991

Notified under the Legislation Act 2001 on 12 September 2001

(see Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Land (Planning and Environment) Amendment Act 2001 (No 3).

  2. Commencement

    This Act commences on the day it is notified in the Gazette.

  3. Act amended

    This Act amends the Land (Planning and Environment) Act 1991.

  4. Application to undertake development
    New section 226 (1AA)

    after subsection (1), insert

(1AA) If the development to which the application relates requires construction work to be carried out on land that has previously been developed, and that is not leased for rural purposes, the application must be accompanied by a survey certificate given by a registered surveyor that shows—

(a)the boundaries of the land where the development is to be undertaken; and

(b)the location of each building or structure on the land; and

(c)the existing contours of the land.

  1. New section 226 (6) and (7)

    insert

  2. The Minister may, in writing, exempt developments mentioned in subsection (1AA) from the application of the subsection.

  3. An exemption is a disallowable instrument.

    NoteA disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act 2001.
