Act No. 165, 1985

An Act to amend the Land Commission Act 1976 as a consequence of, and

in connection with, the enactment of the Housing Act 1985, and in

certain other respects. [Assented to, 3rd December, 1985.]

Land Commission (Housing) Amendment 1985

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the "Land Commission (Housing)

Amendment Act 1985".

Commencement

2.     (1) Sections 1 and 2 shall commence on the date of assent to this

Act.

(2) Except as provided by subsection (1), this Act shall commence on 1

January 1986.

Amendment of Act No. 62, 1976

3. The Land Commission Act 1976 is amended in the manner set forth

in Schedule 1.

(1) Long t i t l e -

Omit the long title, insert instead:

An Act to provide for the exercise by the New South Wales Land and Housing Corporation of certain functions relating to housing and land supply; and for other purposes.

(2) Section 1—

Omit "Land Commission", insert instead "Housing".

(3) Sections 3, 26-32, 34, 36—

Omit the sections.

(4) (a) Section 4, definitions of "Chairman", "Commission",

"commissioner", "part-time commissioner"—

Omit the definitions.

(b) Section 4, definition of "Corporation"—

Before the definition of "council", insert:

"Corporation" means the New South Wales Land and Housing

Corporation constituted by the Housing Act 1985;

(c) Section 4, definition of "Housing Acts"—

After the definition of "functions", insert:

"Housing Acts" means this Act, the Housing Act 1912 and the

Housing Act 1985;

(5) Parts II, IV—

Omit the Parts.

(6) Part III, heading-

Omit "COMMISSION", insert instead "CORPORATION".

(7) Sections 9, 10, 11 (1), 12 (2), 13, 14, 14A, 14B, 14C, 15, 16, 17,

18, 19—

Omit "Commission" wherever occurring, insert instead

"Corporation".

(8) (a) Section 9 (2)—

Before "are" where firstly occurring, insert "under this Act".

(b) Section 9 (2) (e)—

Omit "by or under this or any other Act", insert instead "by the

Housing Acts".

(c) Section 9 (3) (a)—

Omit "Commission's", insert instead "Corporation's".

(9) Sections 10, 11 (1), 12, 13, 17—

Omit "this Act" wherever occurring, insert instead "the Housing

Acts".

(10) Sections 11 (2)-(5), 12 (5)—

Omit the subsections.

(11) Section 18 (2)—

Omit "under section 9 (2) (c)", insert instead "into matters connected with urban development".
