2 Land (Bell Memorial Public Hall) No. 440, 1993 ˙ Short title 1. This by-law may be cited as the Land (Bell Memorial Public Hall) By-law 1993 . ˙ Definitions 2. In this by-law— “authorised agent” , in relation to any thing, means a person authorised by the trustee to act on its behalf in relation to the thing; “hall” means the Bell Memorial Public Hall and other improvements erected on the reserve; “reserve” means lots 503, 504 and 505 on Plan No. B5531 held by the department; “trustee” means Bell Memorial Public Hall Inc. ˙ Hire of hall 3.(1) A person may hire the hall and the equipment in the hall on payment of the reasonable fee fixed by the trustee. (2) The trustee may waive the payment of a fee if the hall is to be used for a purpose that in the opinion of the trustee, is for the benefit of the public. (3) The person hiring the hall is responsible for any damage to, or misuse of, the hall or the equipment in the hall occurring while it is hired. (4) The trustee’s authorised agent may enter the hall while it is hired if it appears to the agent that— (a) there is a likelihood of injury being caused to a person in the hall; or (b) there is a likelihood of damage being caused to the hall or the equipment in the hall; or (c) injury has been caused to a person in the hall; or (d) damage has been caused to the hall or the equipment in the hall; or
3 Land (Bell Memorial Public Hall) No. 440, 1993 (e) the hall is being used for a purpose other than that for which it was hired. ˙ Conduct on reserve 4.(1) A person must not smoke or spit in the hall. (2) While on the reserve, a person must not behave in a disorderly way or in any other way likely to cause a nuisance to others. Maximum penalty—$100.00. ˙ Removal of person from reserve 5.(1) The trustee’s authorised agent may remove a person the agent finds contravening section 4 from the reserve. (2) When removing a person from the reserve, the agent may use necessary and reasonable force. ˙ Reserve a public place 6. The reserve is a public place for the purposes of an Act that— (a) confers on a police officer a power in relation to a public place; or (b) provides for an offence committed in a public place.
