1. Citation
These By-laws may be cited as the Land and Traffic Amendment By-laws 2018.
2. Commencement
These By-laws take effect on the date that they are published in the Government Gazette.
3. By-laws amended
These By-laws amend the Land and Traffic By-laws 2008.

CURTIN UNIVERSITY OF TECHNOLOGY ACT 1966

AMENDING BY-LAW

It is hereby notified that the Governor in Executive Council, acting under the provisions of section 20A of the Curtin University of Technology Act 1966, has approved Curtin University of Technology Land and Traffic Amendment By-laws 2018 as set out in the attached schedule.

CURTIN UNIVERSITY OF TECHNOLOGY

LAND AND TRAFFIC AMENDMENT BY-LAWS 2013

These By-laws are made by the Council of the University, with the approval of the Governor, under the powers conferred on the University by section 20A of the Curtin. University of Technology Act 1966.

4. By-law 1.3 amended

Insert after the definition of 'authorised person'-

"cigarette", "smoke" and "tobacco product" have the meanings given to those terms

respectively in the Tobacco Products Control Act 2006."

5. By-law 2.1 amended
Delete by-law 2.1(2)(a) in its entirety.
6. By-law 2.16A amended

Delete by-law 2. 16A(1) and (2) and replace with-

"A person must not smoke cigarettes or tobacco products on University lands."

7. By-law 3.1 amended

(i) Delete by-laws 3.1(1)(a) and 3.1(1)(b);
(ii) In by-law 3. 1(1)(c), insert at the end of the clause-

"to be paid in an approved manner". (iii) In by-law 3. 1(1)(d), insert after "made"- "or submitted".

8. By-law 3.2 amended

(i) In by-law 3.2(3), delete "holder of a parking permit" and replace with-

"owner of a vehicle".

(ii) Delete by-law 3.2(5) in its entirety and replace with-

"(5) The holder of a parking permit must display the permit so that it is clearly visible to

and be able to be read from outside the front of the vehicle."

9. By-law 3.19 amended

In by-law 3.19(a) insert after the word "By-laws"-

"and acknowledges and agrees that any unauthorised parking of a vehicle is at the vehicle
owner's own risk".

10. By-law 3.20 amended

(i)

Insert new by-law 3.20(1A) after by-law 3.20(1) as follows- "(1A) it is a condition of any parking ticket that-

(a) the holder parks on University Land at his or her own risk; and

(b) the University is not liable or responsible in any way for the safe custody of the vehicle or the contents of the vehicle in respect of which the parking ticket is issued.".

(ii) In by-law 3.20(2)(a) replace "that is marked by a traffic sign as being for the use of visitors" with-

"or other place indicated by a traffic sign for a particular purpose in accordance with that

purpose".

(iii) In by-law 3.20(2)(b) insert at the end of the clause-

"which relates to that parking bay or parking area".

(iv) In by-law 3.20(3) delete "on or in" and replace with-

"and clearly visible to and be able to be read from outside the front of'.

11. By-law 3.21 amended
(i) In by-law 3.21(a) insert after "sign"-

",permit or parking ticket".

(ii) In by-law 3.21( delete "oii'.

(iii) In by-law 3.21(g) insert at the end of the clause-

or

(h)

park a vehicle in a parking bay or parking area which has not been authorised for the purpose intended.".

12. By-law 4.5 amended

In by-law 4.5(4)(a), delete "holder of the parking permit (if any) issued with respect to the vehicle, or to the owner of the vehicle" and replace with-

"owner of the vehicle".

13. By-law 4.6 amendment

In by-law 4.6(1) replace "may" with-

"shall".

14. SCHEDULE
The Schedule is amended-

(i) In Item 2-

(a) insert after "Part 2"—

"(except 2.4)";

(b) delete "or" between "3.21(c)" and "3.21(f)"; and

(c) insert after 3.21(f)—

"or 3.21(h)".

(ii) In Item 4, delete—

"A breach of by-law 3.2(2), 3.2(5), 3.12, 3.17, 3.19, 3.20(3), 3.21(b), 3.21(d) or 3.21(g); or"
