LAND AND ENVIRONMENT COURT ACT 1979—

REGULATION

(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Land and Environment Court Act 1979, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 19 August 1991.

Amendments

2. The Land and Environment Court (Fees) Regulation is amended:

(a) by omitting from item 1 of Schedule 1 the matter “345.00” and

by inserting instead the matter “440.00”;

(b)	by omitting from item 2 (a) of Schedule 1 the matter “110.00” and by inserting instead the matter “130.00”;
(c)	by omitting item 2 (b) and (c) from Schedule 1 and by inserting instead the following matter:
(b) if the value of the development, building or subdivision is $50,000 or more but less than $500,000............................................................. 440.00

(c)	if the value of the development, building or subdivision is $500,000 or more but less than $1,000,000..........................................................	2,000.00
(d)	if the value of the development, building or
subdivision is $1,000,000 or more...............	2,500.00

(d)	by omitting from item 3 of Schedule 1 the matter “110.00” and by inserting instead the matter ‘‘130.00”;
(e)	by omitting from item 4 of Schedule 1 the matter “345.00” and by inserting instead the matter “440.00”;
(f)	by omitting from item 5 of Schedule 1 the matter “110.00” and by inserting instead the matter “130.00”;
(g)	by omitting from item 6 of Schedule 1 the matter “345.00” and by inserting instead the matter “440.00”;
(h)	by omitting item 8 (c) from Schedule 1 and by inserting instead the following matter:

EXPLANATORY NOTE

The object of this Regulation is to amend the Land and Environment Court (Fees) Regulations so as to vary the fees payable for filing a process to commence certain proceedings (for example, proceedings relating to a development, building or subdivision application, proceedings relating to an objection to a valuation of land and proceedings relating to a claim for compensation by reason of the acquisition of land) in all classes of the Land and Environment Court’s jurisdiction, and for filing a bill of costs for taxation and for lodging an objection to such a bill of costs.

The Regulation also introduces further steps in the scales of certain of those fees.
