LAND AND ENVIRONMENT COURT ACT 1979 - REGULATION

(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Land and Environment Court Act 1979, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 January 1991.

Amendments

2. The Land and Environment Court (Fees) Regulation is amended:

(a) by omitting clause 6;

(b)

by omitting Schedule 1 and by inserting instead the following Schedule:

(a) if the value of the development, building or

EXPLANATORY NOTE

The object of this Regulation is to amend the Land and Environment Court

(Fees) Regulation so as:

(a) to repeal clause 6 and thus make government departments and statutory bodies whose expenditure is paid out of Consolidated Revenue liable to pay the fees payable under this Regulation; and
(b) to increase the fees payable in respect of the business of the Land and Environment Court; and
(c) to differentiate the fees payable in respect of proceedings in Class 1 or Class 3 of the Court’s jurisdiction according to the value of the development, building or subdivision application before the Court; and
(d) to prescribe a lower fee in respect of a third party objection (in Class 1 proceedings) under section 98 of the Environmental Planning and Assessment Act 1979; and
(e) to prescribe the fees associated with taxing a bill of costs.
