Land and Environment Court Act 1979

The Land and Environment Court Rules 1996 are amended in the manner

set forth in the Schedule hereto.

Schedule

l . These rules may be cited as the Land and Environment Court Rules (Amendment No. 2) 1997.
2. The Land and Environment Court Rules 1996 are amended in Part 3 rule 3 by omitting sub-rules (1) (c) & (d) and by inserting instead the following:

“(1) (c) that a party produce any document to the Court on a nominated day prior to the hearing of the proceedings and that any other party be permitted to inspect any document so produced;

(1) (d) that a person produce any document at the hearing or on a nominated day prior to the hearing and that any party be permitted to inspect any document so produced;’’

Explanatory Note the production of documents, either pursuant to a subpoena or a notice to produce, on a day prior to the hearing of the proceedings; and (ii) the inspection by a party of any document so produced.
