The Land and Environment Court Rules 1996 are amended in the manner set forth in the Schedule hereto.

Schedule

1.        These rules may be cited as the Land and Environment Court Rules (Amendment No. 1) 1997.

2. The Land and Environment Court Rules 1996 are amended as follows:

(i)	in Part 2—omit rule 9; and
(ii)	following:

in Part 6—insert in rule 1 (l) in numerical sequence the 25 (Division 2).

Explanatory Note
(This note does not form part of the rules)

1.         The object of the amendment contained in paragraph 2 (i) is to repeal the existing rule precluding robing by and in the Court.

2. The object of the amendment contained in paragraph 2 (ii) is to adopt the Supreme Court Rules relating to: (i) summary dismissal of proceedings; and (ii) inspection of property.
