LAND AND ENVIRONMENT COURT ACT RULES

(AMENDMENT No. 6) 1991

NEW SOUTH WALES

[Published in Gazette No. 98 of 28 June 1991]

1. This amendment to the Rules has been made by the Judges of the

Court.

2. This amendment shall commence on 1st July, 1991.

3.  Rule 3 of Division 6A is amended by deleting paragraph (i) and inserting the following paragraph:

(i)

All expert reports (including plans, diagrams and photographs) to be relied upon at the hearing in chief must be served at least fourteen days prior to the date fixed for hearing. Any reports in reply must be served at least seven days prior to the date fixed for hearing.

EXPLANATORY NOTE

(This Note does not form part of the rules)

The purpose of the amendment is to ensure that all expert reports to be relied on at the hearing by all parties be served before the hearing of proceedings in Classes 1 and 2.
