s1 2 s5 Land Amendment (No. 1) No. 141, 1994 ˙ Short title 1. This regulation may be cited as the Land Amendment Regulation (No. 1) 1994 . ˙ Regulation amended 2. This regulation amends the Land Regulation 1988 . ˙ Amendment of s 10 (Categories of leases) 3. Section 10(1)(f)— omit, insert— ‘(f) category 6—Charitable Organisations’. ˙ Amendment of s 12 (Category 2 leases) 4. Section 12(2), ‘section 10’— omit, insert — ‘section 17(2) (Exclusive use for single dwelling house or farming)’. ˙ Replacement of s 12C (Category 6 leases) 5. Section 12C— omit, insert— ˙ ‘ Category 6 leases ‘ 12C. A lease is a category 6 lease only if— (a) the lessee— (i) is a charitable organisation; and (ii) is an organisation whose constitution does not permit its profits to be distributed to its members; and (iii) is not a sporting or recreational organisation; and (b) the lease is used for providing services that are charitable in nature; and

Section 12F— omit, insert— ˙ ‘ Category 10.1, 10.2, 10.3 leases ‘ 12F. A lease is a category 10.1, 10.2 or 10.3 lease whether or not it fulfils the requirements for a different category if— (a) its lessee is a sporting and recreational organisation; and (b) the lessee’s constitution does not permit its profits to be distributed to its members; and (c) the lease is used for sporting and recreational purposes.’. ˙ Amendment of s 44 (Interest rates) 7.(1) Section 44(1), ‘9.5%’— omit, insert — ‘9%’. (2) Section 44(2), ‘and 212(13)’— omit, insert — ‘212(13), 235A(10) and 235B(8)’. (3) Section 44(2), ‘5.5%’— omit, insert — ‘5%’. (4) Section 44(3), ‘9.5%’— omit, insert — ‘9%’. (5) Section 44(4), ‘9.5%’— omit, insert—

(6) Section 44(6), ‘9.5%’— omit, insert — ‘9%’. ˙ Amendment of s 49 (Hardship—s 248A of the Act) 8.(1) Section 49(1)(a) and (b), ‘5.5%’— omit, insert — ‘5%’. (2) Section 49(2), ‘1 September 1993’— omit, insert — ‘1 January 1994’. ˙ Amendment of s 50 (Penalty interest rates—s 249 of the Act) 9. Section 50(1), ‘12%’— omit, insert — ‘11.5%’. ˙ Insertion of new s 56 10. After section 55— insert— ˙ ‘ Category change not to affect rental before 1 July 1994 ‘ 56.(1) If the category of a lease is changed on the commencement of this section from category 6 to category 10.1, 10.2 or 10.3 or from category 10.1, 10.2 or 10.3 to category 6, the change does not take effect for the purpose of rental calculation until 1 July 1994. ‘ (2) This section expires on 2 July 1994.’.
