LAND AMENDMENT ACT

No. 14 of 1986

AN ACT to amend the Land Act 1933.

[Assented to 25 July 1986.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1.     This Act may be cited as the Land Amendment Act 1986.

Commencement

2.     This Act shall come into operation on the day on which it receives

the Royal Assent.

Principal Act

3. In this Act the Land Act 1933* is referred to as the principal Act.

Section 47 amended

4. Section 47 of the principal Act is amended in subsection (5) by

deleting "the fencing of the land has been completed and maintained, the

other" and substituting the following

the ".

Section 50 amended

5. Section 50 of the principal Act is amended in subsection (2) by

deleting the proviso.

Section 53 amended

6. Section 53 of the principal Act is amended in subsection (2)-

(a) by deleting "3" in paragraph "(g)" and substituting the following -

" 7 55;

(b)	by deleting "fence in the whole of the land, and, within 7 years from the said date, in addition to the said fencing" in paragraph (g);
(c)	by deleting "fencing and other improvements," in paragraph (j) (ii) and substituting thefollowing -

" improvements ";

and

(d) by deleting "fencing and other" in paragraph (j).

Section 58 amended

7. Section 58 of the principal Act is amended by deleting ", the land

fenced as prescribed,".

Section 59 repealed

8. Section 59 of the principal Act is repealed.

Section 69 amended

9. Section 69 of the principal Act is amended in subsection (2)-

(a)	by deleting the first paragraph of the subsection;
(b)	by deleting "Provided that where" in the first proviso and substituting the following-

" (a) Where ";

(c) by deleting "Provided also that where" in the second proviso and substituting the following

" (b) Where ";

(d) by deleting "Provided further that if" in the third proviso and substituting the following-

" (c) Where ";

and

(e) by deleting "fencing and other" in the third proviso.

Section 72 amended

10. Section 72 of the principal Act is amended by deleting "fencing

and".

Transitional

11. Notwithstanding anything in the principal Act as in force before the commencement of this Act the provisions of the principal Act as amended by this Act apply to and in relation to conditional purchase leases issued under the principal Act before the commencement of this Act.
