Land Administration (Land Management)

Amendment Regulations 2007

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Land Administration (Land Management) Amendment Regulations 2007.
2.	Commencement These regulations come into operation as follows:

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.            The regulations amended

The amendments in these regulations are to the Land
Administration (Land Management) Regulations 2006*.

4.            Regulation 2 amended

Regulation 2 is amended by inserting in the appropriate alphabetical position

"owner" in relation to something on regulated land,

Regulation 10(6) is repealed and the following subregulation is inserted instead -
(6) A person must not move or otherwise interfere with a

vehicle parked on regulated land unless the person

is -

(a)	the owner of the vehicle; or
(b)	an authorised person acting under regulation 18.

Penalty:

(a)	in the case of a vehicle that was brought onto
the regulated land by an authorised person acting in the course of the person's duties, a fine of $1000;
(b)	in any other case, a fine of $500.

6.             Regulation 11 replaced

Regulation 11 is repealed and the following regulation is inserted instead -

11.           Protection of property

(1) A person must not, on regulated land, deface, damage

or otherwise interfere with any -

(a)	building, fence, jetty, sign or other structure; or
(b)	road, track or path,

unless the person is an authorised person acting in the

course of the person's duties.

Penalty: a fine of$1 000.

(2) A person must not deface, damage, move or otherwise

interfere with any vessel, aircraft, machinery or

equipment on regulated land unless the person is -

(a)	the owner of the vessel, aircraft, machinery or equipment; or
(b)	an authorised person acting under regulation 18.

Penalty:

(a)	in a case where the vessel, aircraft,
machinery or equipment was brought onto the regulated land by an authorised person acting in the course of the person's duties, a fine of $1000;
(b)	in any other case, a fine of $500.

7.            Regulation 18 amended

Regulation 18(3)(a) is amended by deleting "property" and inserting instead —

a thing ".

8.            Regulation 21 amended

Regulation 21(4) is repealed.
