Made by the Governor in Executive Council.
1. Citation
These regulations are the Land Administration Amendment
Regulations (No. 2) 2009.2. Commencement
These regulations come into operation as follows —

These regulations amend the Land Administration
Regulations 1998.4. Regulation 15 replaced
Delete regulation 15 and insert:
15. Phasing in of increased rents for pastoral leases
(1) This regulation applies, for the purposes of
section 124A of the Act, to the annual rent for a
pastoral lease (the 2009 determined rent) that, as the
result of a determination under section 123 of the Act
as at 1 July 2009, is greater than the annual rent for the
lease (the 2004 determined rent) that appliedimmediately before that determination.
(2) Instead of the 2009 determined rent, the annual rent
payable for the pastoral lease -
(a)
as at 1 July 2009 is the amount calculated as set Out in subregulation (3); and
(b)
as at 1 July 2010 is the amount calculated as set Out in subregulation (4).
(3) The annual rent for the pastoral lease as at 1 July 2009
is the amount equal to the sum of—
(a) the 2004 determined rent; and (b)
one third of the difference between the 2009 determined rent and the 2004 determined
rent.
(4) The annual rent for the pastoral lease as at 1 July 2010
is the amount equal to the sum of—
(a) the annual rent as at 1 July 2009, calculated as set out in subregulation (3); and (b) one third of the difference between the rent.
(5) The annual rent for the pastoral lease as at 1 July 2011
is the 2009 determined rent.
