Land Administration Amendment

Regulations 2012

Made by the Governor in Executive Council.

Regulations 1998.

1.             Citation

These regulations are the Land Administration Amendment

Reguhtlions 2012.

2.              Commencement

These regulations come into operation as follows

(a) regulations I and 2 — on the clay on •hich these regulations are published in the Gazette;
(b)
the rest of the regulations on the day after that day.

3.             Regulations amended

These regulations amend the Land Administration

4. Regulation 3 replaced
Delete regulation 3 and insert:

3.             Services prescribed as public utility services

(1) In this regulation
marine naviational (lid means a lighthouse or other
structure intended to aid the navigation of vessels at sea
and includes a helicopter landing, pad if necessary to
access the lighthouse or other structure by helicopter;
survey mark has the same meaning as in the Act
section 268(3 ) ;
teleconinitinications network has the same meaning as
in the Telecommunications Act 1997 (Commonwealth)
section 7.
(2) For the purposes of'the definition of public u!ility
services in section 3(1) of the Act, the foolloing
services are prescribed
(a) services provided by a telecommunications
network;
(b) services provided by a marine navigational aid:
(c) geocentric datum services provided by a survey mark.

5.             Regulation 17F inserted

At the end of Part 2 insert:

I 7F. Commonwealth agencies: section 275A
For the purposes of the definition of'purblic authority in
section 275 1(1) of the Act. the follcnv ing
Common%%ealth agencies are prescribed -
(a) the Australian Electoral Commission
established by the Commonwealth Electoral

Act 1918 (Commonwealth);

(b) the Australian Air Force established by the
Defence Ac! 1903 (Commonwealth);
(c) the Australian Regular Army established by the

Defence Ac! 1903 (Commonwealth);

(d)

the Australian Bureau of Statistics established (Commonwealth);

(e)

the Commonwealth aencv known as Amendment Reguhttions 20/2 came into operation:

(f)

the depat tment of the Commonwealth public service principally assisting the Commonwealth Minister in the administration of an y of the follov•in, Acts

(i) the Primary Industries Levies and

Charges Collection Act 1991;

(ii)      the Quarantine Act 1908 ;

(iii)      the Export Control Act 1982;

(iv)      the Imported Food Control Act 1992.

REMOVAL OF REFUSE, RUBBISH AND DISUSED MATERIALS LOCAL LAW 2012

Under the powers conferred by the Local Government Act 1995 and under all other powers enabling it., the local government of the Shire of Broomehill-Tam bell Up
resolved on the 21st. June 2012 to make the following local law.
1. Citation

This local law may be cited as the Shire of Broomehilt-2ambellup Removal of Refuse,

Res.bb sh and Disused Materials Local Lace 2012.

2. Commencement
This local law comes into operation 14 days after the date of its publication in the

Government Gazer.le.

3. Interpretation

(1) In this local law, unless the context otherwise requires

Act. means the Local Government Act 1995;

district means the district of the Shire of Broome hill-T'ambe11up;
localgovernment means the Shire of Broomehill-Thmbellup;
refuse, rubbish or di.sased material includes-

(i)   any material which is abandoned or unwanted by its owner or the person in possession of it;

(ii)    any material which is not being used for its original intended purpose and which has been deposited or stored upon any property for no current. purpose other than the deposit. storage;

(iii)    any motor vehicle, motor vehicle part or machinery which has been deposited or stored upon any property for the purpose of dismantling or breaking up;

(iv)    any wood, timber, lumber; or cuttings. logs or remnants of trees; or chopped, split or chipped wood, deposited, stored, located or placed on proi^erty;
