LABOUR-LAND. 129 12 GEO. VI. No. 17,1948. Land Acts and Other Acts Amendment Act. 4. Section 14B of the Principal Act is amended as Amendment follows :_ of s. 14B. (i.) In paragraph (iii.) of provision A of subsection two thereof the words "eight hundred pounds" are repealed and the words "one thousand pounds" are inserted in lieu of such repealed words. (ii.) In paragraph (i.a) of provision B of the said subsection two the words" twelve shillings and six pence" are repealed and the words " one pound " ar8 inserted in lieu of such repealed words. (iii.) In the proviso to paragraph (ii.) of the said provision B the words" fifty-five shillings" are repealed and the words" three pounds two shillings and six pence" are inserted in lieu of such repealed words; and the words "or the sum of one thousand pounds in all, irrespective of the period during which the incapacity continues" are repealed. E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I.-PRELIMINARY. PART I.- PRELIMINARY. 1. This Act may be cited as " The Land Acts and Short title. Other Acts Amendment Act of 1948." 2. This Act is divided into Parts, as follows:- Parts of Act. This Part of this Act shall be read as one with of Part H. t"The Land Acts, 1910 to 1946," and that Act a.nd this Part may collectively be cited as " The Land Acts, 1910 to 1948." Amendment 4. In section four of t"The Land Acts, 1910 to 1946," of s. 4. the definition of the term " Public Purposes" is amended by inserting the words "War Memorial or Soldiers' Memorial Hall " after the words" Scientific purposes." Amendment 5. The following paragraph is added to subsection of s. 41 (5). one of section forty-one of t"The Land Acts, 1910 to 1946," namely:- " Moreover where a notification opening land as a preferential pastoral holding specifies payment of a, survey fee the !'LP plication shall also be accompanied by an amount equal to one-fifth part of the specified survey fee, which shall be returned to the applicant if the application is not!·accepted." Amendment 6. The following paragraph is inserted after ofa.43. paragraph (ii.) of section forty-three oft"The Land Acts, 1910 to 1946," namely :- " (ii.a) (In the case of a preferential pastoral lease where a notification opening the land for such lease specified payment of a survey fee) the lessee shall pay in four equal annual instal- ments, without interest, as and by way of addition to the annual rent for each of the four years next followmg the year ending the thirtieth day of June in which the term of the lease commenced, the remainder· of the prescribed survey fee which was not lodged with the application. Section 1750 of *"The Land Acts, 1910 to 1946," Am~ ~ ~ ~ nts is amended as follows :- of s. 1750. (i.) In the first paragraph thereof the words "or for accommodating and/or providing recreational and other facilities for tourists" are inserted after the words " industrial enterprise". (ii.) The second paragraph thereof is repealed and the following paragraph is inserted in lieu thereof, namely:- " Every such lease shall be subject to the following conditions, that is to say :-- (a) A condition that specified buildings or developmental works shall be erected or constructed on the land within a specified time; and (b) All such other conditions as the Governor in Council shall fix including (but without limit to the generality of the power of the Governor in Council to fix the conditions of a lease under this section) as respects a lease under this section for tOUrIst purposes the obligations, duties and responsibilities to be undertaken, observed and performed by the lessee in relation to tourists, or in relation to any specified State Forest, National Park or other Crown land, or in relation both to tourists and to any specified State Forest, National Park or other Crown land." 8. Section two hundred and three of *"The Land Amendment Acts, 1910 to 1946," is amended by adding thereto the ofs. 203. following paragraph, namely:- " For the purposes of this section the term " Crown land" includes any road." 9. This Part of this Act shall be read as one of Part nI. with *"The State Forests and National Parks Acts, 1906 to 1941," and that Act and this Part may be collectively cited as "The State Forest8 and National Parks Acts, 1906 to 1948." Amendment 11. The first paragraph of section four of *" The of s. 4. State F01'e8ts and National Parks Acts, 1906 to 1941," is amended by adding thereto the words "or except under the provisions of section 4A of this Act." New s. 4A inserted. 12. The following section is inserted after section four of *"The State Forests and ~ 7\ , Tational Parks Acts, 1906 to 1941," namely ; - " [4A.] Where the Governor in Council is satisfied that it IS desirable to make any land comprised in a State Forest or National Park available for the provision of accommodation and/or recreational or other facilities for the purpose of encouraging and promoting the tourist industry, the Governor in Council may, by Proclamation, exclude such land from such State Forest or National Park. Any land so excluded shall become and be Crown land and may be dealt with by the Governor in Council under the provisions of t"The Land Acts, 1910 to 1948," in such manner as he deems best calculated to ensure its use for the purposes for which it was so excluded." " [12A. ] (1.) For the purposes of this Act the Power to Minister may, by agreement with the owner concerned, ~ ~ ~ : ~ ~ einor arrange for a grant in fee-simple or for any less estate of lieu of any land acquired under this Act- ~fo~~ensa. (i.) In exchange for any adjacent land of equal value; or (ii.) In payment or satisfaction in whole or in part of any land of that owner acquired under this Act. (2.) The value of lands so exchanged and, in the case of an agreement for any such grant, both the value of the lands to be granted and of the lands for which the grant is payment or satisfaction in whole or in part and, where necessary, of any improvements on any such lands shall be determined by the Land Court. (3.) The Governor in Council may, according as is agreed upon between the Minister and an owner of land, grant to that owner in fee-simple or for any less estate the land which under the agreement is to be granted to * 9 G. 6 No. 25. t 1 G. 5 No. 15 and amending Acts.

(4.) Lands separated by a road or watercourse shall for the purposes of this section be deemed to be adjacent.
