AN ACT to amend sections ninety-eight and one hun-

dred and one A of the Land Act, 1933-1937.

[Assented to 22nd December, 1938.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis-

lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Land Act Amendment Short title.

Act, 1938, and shall be read as one with the Land Act, 1933-1937 (No. 37 of 1933, as amended by Acts No. 47 of 1934, No. 4 of 1936, and No. 39 of 1937), hereinafter re- ferred to as the principal Act.

Section ninety-eight of the principal Act is Amendment

(a) by adding to subsection (3) a further proviso as

follows:—

Provided that, in the case of applications for pastoral leases made after the commencement of this proviso and approved, no rent shall be payable by the lessee during the first five years of the term of the pastoral lease so approved, but subject thereto the provisions of this section shall apply;

(h) by inserting at the beginning of subsection (4) the words "Subject to the third proviso to subsec- tion (3) of this section."

Amendment

Section one hundred and one A of the principal Act (inserted by the Act No. 4 of 1936 and amended by the Act No. 39 of 1937) is repealed and a section is in- serted in lieu thereof as follows:-

suffered serious loss of stock through drought, or that his wool production in respect of stock on any pastoral lease has been adversely affected by drought, the Minister may grant the lessee relief from payment of rent payable under such pastoral lease in respect of that year : Provided that no such relief shall be granted, except on the recommenda- tion of the Board of Appraisers appointed under section ninety-eight of this Act.

(2) The relief granted under this section may be

total or partial, and may take the form of extended

terms for the payment of the rent payable under the

pastoral lease.
