No. 39 of 1937.

AN ACT to amend Sections forty-seven and one hun-

dred and one A of the Land Act, 1933-1936.

[Assented to 18th ;January, 1938.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and Ly the authority of the same, as follows:-

1.    This Act may be cited as the Land Act Amendment Short ti tle.

Act, 1937, and shall be read as one with the Land Act, 1933-1936 (Act No. 37 of 1933 as amended by Acts No. 47 of 1934 and No. 4 of 1936), hereinafter referred to as the principal Act.

Section forty-seven of the principal Act is amended Amendment

of a. 47.

by deleting the proviso to subparagraph (a) of para- graph (1) of the section and inserting in lieu thereof a proviso as follows:

Provided that-

(i)    for the purposes of this paragraph, five acres

of grazing land shall be deemed to be the equivalent

of two acres of cultivable land;

(ii)    the Governor may reduce the maximum area

that may be acquired in prescribed localities;

on the recommendation of the Minister and with the approval of the Governor, it shall be com- petent for persons in particular localities or in special cases to acquire an area of land in one or more parcels exceeding one thousand acres of cul- tivable land but not in any event exceeding two thousand acres of cultivable land or the equivalent thereof.

3. Section one hundred and one A of the principal

of s. 101A.

Act (inserted by the Act No. 4 of 1936) is amended by inserting in subsection (1) thereof after the words "thirty-seven" in line five of the said subsection the words "or the year ending the thirty-first day of Decem- ber, one thousand nine hundred and thirty-eight."
