AN ORDINANCE

To amend the Lakes Ordinance 1976

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administra­ tion) Act 1910.

LAKES (AMENDMENT) ORDINANCE 1978

1. This Ordinance may be cited as the Lakes (Amendment) Ordin­

ance 1978.*

2. In this Ordinance, "Principal Ordinance" means the Lakes Ordinance 1976.f

3 . Section 4 of the Principal Ordinance is amended by omitting paragraph (b) of the definition of "foreshores" in sub-section (1) and substituting—

" ( b ) in relation to any other lake—the area of land bounded by the level of the lake and an imaginary line drawn at a distance of 100 metres from the high water level of the lake,

other than land held under lease from the Commonwealth or occupied with the authority of the Commonwealth or by virtue of a law in force in the Territory;".

4 . Section 9 of the Principal Ordinance is amended by omitting from paragraph (1) (a ) " at any time " and substituting " where he has reasonable grounds for believing that an offence against this Ordinance is being, or has been, committed,".

5. After section 22 of the Principal Ordinance the following section

is inserted:—

" 22A. The Minister shall not—

(a) in a notice under section 21, prohibit entry to or declare to be a prohibited area; or

(b) in a notice under section 22, declare to be a closed area, part of a lake area that provides access to land held under lease from the Commonwealth or occupied with the authority of the Common­ wealth or by virtue of a law in force in the Territory.".

6.   Section 25 of the Principal Ordinance is amended—

(a) by inserting after sub-section (1) the following sub­ section:—

" (1A) A permit issued under this section remains in force for such period, not exceeding one year, as is speci­ fied in the permit and may be renewed on payment of the prescribed fee."; and

(b) by omitting from sub-section (2) "sub-section (1)" and substituting " this section ".

7.   Schedule 1 to the Principal Ordinance is amended by omitting— "Lake Burley Griffin Ordinance (No. 2) 1975 "

and substituting—

" Lake Burley Griffin Ordinance 1975 ".
