1      Name of Plan

This Plan is Lake Macquarie Local Environmental Plan 2014 (Amendment No 36).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land at 2A Main Road, Boolaroo, being part of Lot 599, DP

1228699.

4      Maps

The maps adopted by Lake Macquarie Local Environmental Plan 2014 are amended or replaced, as the case requires, by the maps approved by the local plan-making authority on the making of this Plan.

5 Amendment of Lake Macquarie Local Environmental Plan 2014

Part 7 Additional local provisions

Insert at the end of the Part, with appropriate clause numbering—

Development on certain land at 2A Main Road, Boolaroo

(1)

This clause applies to land identified as “Boolaroo Large Format Retail Site” on the Key Sites Map, being part of the former Pasminco Cockle Creek Smelter site.

(2)

Development consent must not be granted to development on land to which this clause applies for the purposes of retail premises unless the consent authority is satisfied that—

(a)

the site area of the development is at least 20,000 square metres, and

(b)

the gross floor area of the retail premises is at least 13,000 square metres, and

(c)

the resulting retail premises are to be operated by a single person.
