Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Lake Macquarie Local Environmental Plan 2004 (Amendment No 59).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land in the vicinity of Minmi Road and Transfield Avenue at Edgeworth, being Lot 1, DP 900356, Lot 1, DP 900357, Lot 111, DP 665948, Lot 1, DP 921714, Lot 1, DP 921545, Lot 27, DP 202567, Lots 1 and 2, DP 250063, part of Transfield Avenue and adjacent road reserves, as shown edged heavy black and lettered “2 (1)” and “7 (1)” on the map marked “Lake Macquarie Local Environmental Plan 2004 (Amendment No 59)” deposited in the office of Lake Macquarie City Council.

13 Land at Edgeworth in the vicinity of A development control plan for the land must

Minmi Road and Transfield Avenue,	have been approved by the Council before
being Lot 1, DP 900356, Lot 1,	development consent is granted for any
DP 900357, Lot 111, DP 665948, Lot 1,	development. The provisions of the development
DP 921714, Lot 1, DP 921545, Lot 27,	control plan are to include, but are not limited to,
DP 202567, Lots 1 and 2, DP 250063,	the following matters:
part of Transfield Avenue and adjacent	(a) a staging plan for the timely and efficient
road reserves, as shown edged heavy

black and lettered “2 (1)” and “7 (1)”	release of urban land making provision
on the map marked “Lake Macquarie	for necessary infrastructure and
Local Environmental Plan 2004	sequencing,

(Amendment No 59)”.	(b)	an overall transport movement hierarchy
that:
(i) and connections to achieve a simple and safe movement system for private vehicles, public

shows the major circulation routes and

(ii)       provides for an arterial road linking Frederick street with Minmi Road at Edgeworth,

areas and remnant vegetation, including

visually prominent locations, and detailed

an overall landscaping strategy for the public and private domain,

an assessment of the impact of development on flora and fauna and measures to mitigate any adverse impact,

a network of passive and active recreational areas,

(f)

stormwater and water quality

management controls,

(g)

environmental hazards, including

amelioration of natural and and, in relation to natural hazards, the safe occupation of, and the evacuation from, any land so affected,

(h)	detailed urban design controls for significant development sites,
(i)

measures to encourage higher density service nodes.
