1      Name of Plan

This Plan is Lake Macquarie Local Environmental Plan 2004

(Amendment No 56).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land known as 11, 13 and 21 John Street, Warners Bay, being Lot 53, DP 1128122, Lots A and B, DP 162087 and Lot 10, DP 1128914, respectively.

[1]      Clause 61 Classification and reclassification of public land as operational land

Insert “Part 1 or Part 2 of” before “Schedule 3” in clause 61 (1).

[2]      Clause 61 (1A)

Insert after clause 61 (1):

(1A)

The public land described in Part 1 of Schedule 3:

(a)	does not cease to be a public reserve to the extent (if any) that it is a public reserve, and
(b)	continues to be affected by any trusts, estates, interests, dedications, conditions, restrictions or covenants that affected the land before its classification, or reclassification, as operational land.

Insert “Part 2 of” before “Schedule 3” wherever occurring.

Omit the heading (including the clause cross-reference). Insert instead:
