Lake Macquarie Local Environmental Plan 2004

(Amendment No 34)

under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Lake Macquarie Local Environmental Plan 2004

(Amendment No 34).

2      Aims of plan

The aims of this plan are:

(a)	to rezone certain land at Belmont from Zone 7 (2) Conservation (Secondary) Zone to Zone 6 (2) Tourism and Recreation Zone under Lake Macquarie Local Environmental Plan 2004 (the 2004 plan) to allow the land to be used for tourist and recreation purposes, and
(b)	to rezone certain land at Charlestown from Zone 10 Investigation Zone to Zone 2 (1) Residential Zone under the 2004 plan to allow the land to be used for residential purposes, and
(c)	to rezone certain land at Dudley from Zone 7 (5) Environmental (Living) Zone to Zone 2 (1) Residential Zone under the 2004 plan to allow the land to be used for residential purposes, and
(d)	to rezone certain land at Speers Point from Zone 6 (1) Open Space Zone to Zone 2 (1) Residential Zone and Zone 7 (2) Conservation (Secondary) Zone under the 2004 plan to allow the land to be used for residential and conservation purposes.

3      Land to which plan applies

(1) With respect to the aim referred to in clause 2 (a), this plan applies to certain land at 50 Alick Street, Belmont, being part Lot 801, DP 1066865 as shown edged heavy black and lettered “6 (2)” on Sheet 1 of the map marked “Lake Macquarie Local Environmental Plan 2004 (Amendment No 34)” deposited in the office of Lake Macquarie City Council.

(2)	With respect to the aim referred to in clause 2 (b), this plan applies to certain land at 361 Warners Bay Road, Charlestown, being Lot 1, DP 879999 as shown edged heavy black and lettered “2 (1)” on Sheet 2 of that map.
(3)	With respect to the aim referred to in clause 2 (c), this plan applies to certain land at 1B Ocean Street, Dudley, being part Lot 71, DP 530474 as shown edged heavy black and lettered “2 (1)” on Sheet 3 of that map.
(4)	With respect to the aim referred to in clause 2 (d), this plan applies to certain land at 1 Cornish Street, Speers Point, being part Lot 162, DP 519129 as shown edged heavy black and lettered “2 (1)” and “7 (2)” on Sheet 4 of that map.

4 Amendment of Lake Macquarie Local Environmental Plan 2004

Lake Macquarie Local Environmental Plan 2004 is amended by inserting in appropriate order in the definition of the map in the Dictionary the following:
