The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (Meagher and Leeming JJA, Preston CJ of LEC), dismissing an appeal against a decision of the Land and Environment Court of New South Wales (Moore J) but upholding the second respondent's notice of contention and setting aside a proportional costs order against the applicant.

  2. The application does not give rise to any question of general importance. Further, the proposed appeal lacks sufficient prospects of success to warrant a grant of special leave to appeal.
