171 (Quecnsluub ANNO DECIMO ELIZABETHAE SECUNDAE REGINAE ••••••••••••••••••••••••••••••••••••••••••••••••••• No. 40 An Act to Amend "The Labour and Industry Acts, 1946 to 1960," in certain particulars [ASSENTED TO 11 TH DECEMBER, 1961] B E it enacted by the Queen's Most Excellent Majesty, _ by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- !. (I) This Act may be cited as " The Labour and Short title Industry Acts Amendment Act of 1961." (2) "The Labour and Industry Acts, 1946 to 1960," Principal are in this Act referred to as the Principal Act. Act (3) The Principal Act and this Act may be <;ollective collectively cited as " The Labour and Industry Acts, 1946 title to 1961." 2. Section twenty-four of the Principal Act is Amendments amended by- of s. 24 (a) in subsection (3) omitting the words "and such members, other than the ex officio member, shall hold office at the pleasure of the Governor in Council " ; and
172 Labour and Industry Acts, Etc., Act 10 ELIZ. IL No. 40, (b) omitting subsection (5) and inserting in its stead the following subsection :- " (5.) (a) Subject to this subsection every member, other than the ex officic member, of the Board- (i) shall be eligible for re-appointment ; and (ii) shall hold office for the term for which he is appointed or re-appointed but no such appointment or re-appointment shall be for a term exceeding three years. (b) The office of any member, other than the ex officio member, of the Board shall become vacant if he- (i) dies or becomes mentally sick ; (ii) becomes bankrupt or compounds with his creditors, or otherwise takes advantage of the laws in force for the time being relating to bankruptcy ; (iii) is absent without leave granted by the Board from three consecutive meetings of the Board of which due notice has been given to him ; (iv) resigns his office by writing under his hand delivered to the Minister and the resignation is accepted by the Minister ; (v) is convicted of an indictable offence ; or (vi) is removed from office by the Governor in Council for misbehaviour or incompetence by notification published in the Gazette. (c) Attendance of a member at the time and place appointed for a meeting of the Board shall be deemed to constitute presence at a meeting notwithstanding that by reason that no quorum is present no meeting is actually held on that day, and the secretary shall enter in the minute book the name of any member who so attends." Amendment 3. Subsection (3) of section twenty-eight of the of s. 28 (3) Principal Act is amended by adding the following paragraphs :- " The Board may refer any application which relates to a place or locality outside the Area of the City of Brisbane to any person residing or carrying on business in such place or locality who in its opinion has experience or capacity in the industry to which the application relates or knowledge of the industrial and economic conditions prevailing in such place or locality.
1961 Labour and Industry Acts, Etc., Act 173 Such reference shall be for the purpose of enabling such person to report to or confer with the Board concerning such of the matters set out in subsection (2) of this section, and such other matters deemed by the Board to be relevant to the application, as the Board determines. Where the Board arranges with a person to whom it makes such a reference to confer with it in Brisbane thereon, it may make to him an allowance in respect of travelling and other expenses incurred by him in carrying out the arrangement : Provided that the amount or rate of such allowance shall not, in respect of any travelling or other expenses, exceed such amount or rate as the Minister, who is hereby thereunto authorised, fixes from time to time." 4. Subject to subsection (5) of section twenty-four sitting of "The Labour and Industry Acts, 1946 to 1961," as members enacted by this Act, every member, other than the ex officio member, of the Industries Assistance Board, in office at the date of the passing of this Act shall- (a) by virtue of his subsisting appointment, continue in office for a term of three years commencing on and including the date of the passing of this Act, and no longer ; (b) be eligible for re-appointment.
