AN ACT to sever portion of the Rockingham head District from that Road District, to constitute the portion a road district and place it under the control of a Commissioner under the name of Kwinana Road Board and for other purposes.

BE it enacted, by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Kwinana Road Short title.

(2) Where the portion is severed from the Road District as provided in subsection (1) of this section

the land comprising the portion is not to be regarded as outlying land within the meaning of that Act.

6.    (1) Subject to the provisions of this Act, the cTi=.

person who is first appointed as Commissioner under the provisions of this Act, shall be appointed to hold office for a term of not less than three years nor more than five years from the date of the appoint- ment, but upon expiration of the term of appoint- ment, is eligible for re-appointment for a term not exceeding two years from the date of the re-appoint- ment or during the pleasure of the Governor.

(2) Where the Commissioner is not re-appointed as provided in subsection (1) of this section, the Governor may, by Order in Council, appoint another person having the requisite qualifications to be Commissioner for a term not exceeding two years or during the pleasure of the Governor.

7.    (1) Subject to the provisions of this Act, the accrgata,

Act by or on behalf of the Kwinana Road Board, other than such as are referred to in section thirty-five of the Constitution Acts Amendment Act, 1899-1950;

(d) resigning or dying;

(e)

being absent from his duties for a period of one month or longer without the consent of the Minister;

(f)

being guilty of misbehaviour or incapacity;

(g)

failing to observe the provisions of the Road Districts Act, 1919-1951.

(2) Where the office of Commissioner becomes vacant by reason of the case mentioned in paragraph (g) of the next preceding subsection, section one hundred and twenty-two of the Road Districts Act, 19194951 does not apply.

8. (1) When the office of Commissioner becomes vacant otherwise than by effluxion of the term for which the occupant was appointed, the Governor may appoint to the vacant office for the remainder of that term, a person having the requisite qualifica- tions and on the expiration of the remainder, the person is eligible for re-appointment.

(a) The Governor may appoint a person, who has the requisite qualifications to act in the place and during the absence of the occupant of the office of Commissioner, as deputy for that occupant until the appointment is cancelled by notice published in the Gazette.

(b) A person so appointed has, while acting as deputy, all the powers and shall perform all the duties of the Commissioner.

(3) No appointment of, and no act, matter or thing, done by a person as a deputy of the Commis- sioner shall be questioned on the ground that the occasion for the appointment had not arisen or had ceased.
