KURRI KURRI SCHOOL OF ARTS (LAND SALE)

ACT.

An Act to enable the Trustees for the time being of the Kurri Kurri School of Arts to sell certain lands at Kurri Kurri and to transfer the same free from all trusts estates and interests affecting such lands and for purposes connected therewith. [Assented to, 31st March, 1964.]

WHEREAS at all material times the whole of the land

has been vested in the Trustees for the time being of the comprised in Certificate of Title Volume 3849 Folio 69 Kurri Kurri School of Arts AND WHEREAS in the year One thousand nine hundred and fifty-four the then Trustees of the Kurri Kurri School of Arts convened a Public Meeting with a view to the establishment of a Workers' Club at Kurri Kurri AND WHEREAS at the said meeting held on the twentieth day of May One thousand nine hundred and fifty- four it was resolved that such a club be formed and estab­ lished AND WHEREAS the Kurri Workers' Co-operative Club was subsequently formed and registered under the name, of "Kurri Workers' Co-operative Club Limited" under the provisions of the Co-operation Act, 1923-1954 AND WHEREAS since its formation the Kurri Workers' Co-opera­ tive Club Limited by arrangement with the Trustees of the Kurri Kurri School of Arts has used part of the said premises of the said School of Arts situated upon the said land for the purposes of the said Club AND WHEREAS from time to time the Kurri Workers' Co-operative Club Limited has effected improvements to the premises of the said School of Arts situated upon the said land AND WHEREAS the said land and the improvements erected thereon are valued at Fifty-three thousand one hundred Pounds of which the sum of Forty-eight thousand Pounds is attributable to improve­ ments erected by the Kurri Workers' Co-operative Club Limited AND WHEREAS in the course of making the improvements to the said premises improvements to the value of Two thousand Pounds were demolished AND WHEREAS the said land and the improvements erected thereon are no longer required for the purpose of a School of Arts AND

WHEREAS

WHEREAS the Trustees of the Kurri Kurri School of Arts have by a contract of sale bearing date the first August One thousand nine hundred and sixty-three agreed to sell and the Kurri Workers' Co-operative Club Limited has agreed to buy the whole of the land comprised in Certificate of Title Volume 3849 Folio 69 with the improvements erected thereon for the sum of Seven thousand one hundred Pounds AND WHEREAS the Trustees of the Kurri Kurri School of Arts have no power or authority to sell for the said sum AND WHEREAS it is expedient to authorise the Trustees of the Kurri Kurri School of Arts to sell the said land and improve­ ments and to transfer the same to the Kurri Workers' Co-operative Club Limited for such consideration and in accordance with the terms and conditions of the said contract entered into between them for an estate in fee simple freed and discharged from all trusts estates and interests affecting the same BE it therefore enacted by the Queen's Most Excel­ lent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same as follows : —

This Act may be cited as the "Kurri Kurri School of Arts (Land Sale) Act, 1964".

1.

The Trustees of the Kurri Kurri School of Arts for the time being may and are hereby authorised to sell and transfer and execute all conveyances and instruments required to effect such transfer to the Kurri Workers' Co-operative Club Limited the whole of the land described in the Schedule

to this Act, together with the improvements erected thereon
for the sum of Seven thousand one hundred Pounds for an
estate in fee simple freed and discharged from all trusts estates
or interests affecting the same.

3. The receipt of the Trustees for the time being of the Kurri Kurri School of Arts shall be sufficient discharge to the Kurri Workers' Co-operative Club Limited for the purchase money of Seven thousand one hundred Pounds.

4 The proceeds of sale after payment of all costs expenses and encumbrances shall be held by the Trustees for the time being of the Kurri Kurri School of Arts for the general purposes of the Trust and shall be invested and applied as the Minister administering the Public Instruction Act of 1880 or any Act in substitution of the same may from time to time direct.

The Registrar-General, upon a duly stamped transfer in fee simple by the Trustees of the Kurri Kurri School of Arts to the Kurri Workers' Co-operative Club Limited of the land described in the Schedule to this Act being lodged for registration and upon payment of the fees prescribed, shall issue to the Kurri Workers' Co-operative Club Limited a certificate of title to the said land free of any caveat or notification that the same is affected by any trust estate or interest affecting the same.
