1      Name of Plan

This Plan is Ku-ring-gai Local Environmental Plan No 217.

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land within Zone No 2 (a) Residential “A”, Zone No 2 (b) Residential “B”, Zone No 2 (c) Residential “C” and Zone No 6 (a) Recreation Existing under the Ku-ring-gai Planning Scheme Ordinance.

Amendment of Ku-ring-gai Planning

Scheme Ordinance

[1]      Clause 4 Interpretation

Insert in alphabetical order in clause 4 (1):

emergency services facility means a building or place (including a helipad) used in connection with the provision of emergency services by an emergency services organisation.

emergency services organisation means any of the following:

(a)	Ambulance Service of New South Wales,
(b)	Fire and Rescue NSW,
(c)	NSW Rural Fire Service,
(d)	NSW Police Force,
(e)	State Emergency Service,
(f)	New South Wales Volunteer Rescue Association Incorporated,
(g)	New South Wales Mines Rescue Brigade established under the Coal Industry Act 2001,
(h)	an accredited rescue unit within the meaning of the State Emergency and Rescue Management Act 1989.

Insert “emergency services facilities;” after “commercial premises;” wherever occurring in Column 4 of the matter relating to Zone No 2 (a) Residential “A”, Zone No 2 (b) Residential “B” and Zone No 2 (c) Residential “C” in the Table.
