McHUGH J:   This case was heard in Canberra by Justices Gaudron, Gummow, Kirby, Hayne and myself on 12 November 1997.  We are in a position to make an order in this matter.  Our reasons will be published in due course. 

The order of the Court is:

(1)  Appeal allowed;

(2)  Set aside the order of the Court of Criminal Appeal of Western Australia and in lieu thereof order that the appeal to that court be allowed, the convictions quashed and a new trial ordered.
