1. The applicant seeks the removal to this Court of pending proceedings in the County Court of Victoria. The application does not disclose a proper basis for removal under s 40 of the Judiciary Act 1903 (Cth).

2. That conclusion on the merits of the application makes it unnecessary to address the respondent's application for orders pursuant to s 77RN of the Judiciary Act 1903 (Cth).

3. Pursuant to r 26.07.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
